The following terms & conditions apply to all transactions at Plasma-World,
a division of Easirent Limited and the use of our website constitutes acceptance
of these terms & conditions. The placing of an order also confirms your acceptance
of our terms & conditions.

- Definition
In these terms and conditions the following words shall have the following meanings herein ascribed to them.
The 'Company' shall mean Plasma-World a division of Easirent Limited whose registered office is at 7 St John's Road, Harrow, Middlesex, HA1 2EY.
The 'Customer' shall mean any party with whom the Company enters into a contract
or the person who buys or agrees to buy the Goods from the Company.
'The Contract' shall mean the contract entered into between the Company and the Customer of which these terms and conditions shall form part.
'Equipment' shall mean the subject matter or Goods of the Contract or (as the case may be) any part thereof together with all packaging materials in respect thereof.
- Acceptance and Responsibility
2.1.Acceptance by the Company of any offer for purchase of Equipment is subject
to these terms and conditions and may not be varied save by agreement in
writing by the Company.
2.2.The Customer accepts responsibility for the selection of the Equipment.
- Accuracy of Product Information
Whilst every effort is made to endeavor at all times to provide you with up to
date and accurate information on all the products we sell, all product specifications,
information and images have been made accessible from manufacturers, suppliers and publications,
Plasma-World the Company cannot therefore guarantee the accuracy of the information contained
within our website and any actions taken by the user of our site are the sole responsibility
of the person.
- Payment & Payment Terms
The Price of the Equipment or Goods shall be that stipulated in the Company's current price list at the date of order. The Price is exclusive of VAT, if applicable, but exclusive of delivery charges, if applicable.
Payment of the Price (excluding VAT and delivery charges, if applicable) must be made in full before dispatch of the Goods.
- Conditions
5.1. Nothing in these Terms and Conditions shall affect the Customer's statutory
rights as a consumer.
5.2. These Terms and Conditions shall apply to all contracts for the sale of Goods
by the Company to the Customer and shall prevail over any other
documentation or communication from the Customer.
5.3. All orders for Goods shall be deemed to be an offer by the Customer to
purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Company. The Customer may choose not to accept an order for any reason.
5.4. Acceptance of delivery of the Goods shall be deemed conclusive evidence of
the Customer's acceptance of these Terms and Conditions.
- Refund Policy
In certain situations, we may consider giving you a refund for equipment that you are not entirely satisfied with.
Full details of our policy on refunds can be found in our refund policy statement of which a copy is available on request.
- Product Warranties
Most of our products offered have a manufacturers 12 month return to base warranty. Should a fault occur within this period, it is your responsibility to contact the manufacturer and arrange yourself, to return the faulty product for repair back to the address as stated by the manufacturer at the time. The manufacturers warranty starts from date of purchase. Plasma-World sell equipment where new, with the benefit of and is subject to the terms applicable to such warranty as is given by the manufacturer of the equipment.
- The Equipment
The description and quantity of the Equipment or Goods to be sold shall be as set out in the quotation provided by the Company to the Customer ("the Quotation").
- Delivery
9.1. Delivery of the Goods shall be made by the Company notifying the Customer
that the Equipment or Goods are available for collection at the Company's
premises or for delivery to such place as agreed between the Company and
the Customer at the time the order is placed.
9.2. All Equipment or Goods, wherever possible, will be delivered within 30 days of
the order being placed and the Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for
delivery.
9.3. The Company shall use its reasonable endeavors to meet any date stated for
delivery. In any event time of delivery shall not be of the essence and the
Company shall not be liable for any losses, costs, damages or expenses
incurred by the Customer or any third party arising directly or indirectly out of
any failure to meet any estimated delivery date.
9.4. Some Equipment or Goods may not be in stock at the time the order is placed.
In the event that the Company is unable to deliver the Goods within 30 days
of receipt of the order, the Company will contact the Customer to advise of the
situation and the Customer shall be entitled to cancel the order and receive a
full refund or agree a later delivery date.
9.5. Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.
- Cancellations & Returns
10.1 The Buyer shall inspect the Goods immediately upon receipt and shall notify
the Company within 7 Days of delivery if the Goods are damaged or do not
comply with any of the Contract.
10.2 Where a claim of defect or damage is made the Goods shall be returned by
the Customer to the Company. The Customer shall be entitled to replacement
Goods or a full refund (including delivery costs, if applicable) plus any return
postal charges if the Goods are in fact defective.
10.3 Goods to be returned must clearly show the order number obtained from the
Company on the package.
10.4 Where returned Goods are found to be damaged due to the Customer's fault
the Company will be liable for the cost of remedying such damage.
- Guarantees
11.1 In addition to the Customer's statutory rights, the Company guarantees all
Goods against faulty workmanship and materials for a period of 12 months
from the date of delivery.
11.2 These guarantees do not cover fair wear and tear, neglect, abuse or misuse of
the Goods, loss or damage due to fire, smoke, lightning, sunlight, weather,
rusting, corrosion, infestation by animals or boring insects, theft or explosion,
or accidental damage or consequential loss.
11.3 Guarantees may be transferred to a new owner free of charge by notifying
the Company in writing.
- Limitation OF Liability
12.1 Save in respect of personal injury or death due to the negligence of the
Company, the Company shall not be liable to the Customer in respect of any
loss suffered to the Customer due to any defect in the Goods.
12.2 Without prejudice to Clause 12.1 the Company shall not be liable to the
Customer or any third party for any loss of profit, consequential or other
economic loss suffered by the Customer arising in any way from this
Agreement.
12.3 Save in respect of personal injury or death due to the negligence of the
Company, the liability of the Company under these Terms and Conditions
shall not exceed the Price of the Goods.
- Data Protection Compliance
At all times the Company will observe the requirements imposed by the Data Protection Act
1998 and will provide the appropriate security to maintain the confidentiality of
the Customer's personal data.
- Force Majeure
Neither the Company nor the Customer shall be held liable for any failure to
perform any obligation to the other due to causes beyond their respective reasonable control.
- Severance
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
16. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with
the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
